Frequently Asked Questions

What is the difference between an AHA tenancy and a Farm Business Tenancy?
Agricultural Holdings Act (AHA) tenancies were granted before 1 September 1995 and carry security of tenure and potentially succession rights for qualifying successors. Farm Business Tenancies (FBTs), governed by the Agricultural Tenancies Act 1995, are more flexible arrangements with fewer statutory protections. The distinction has significant implications for both landlords and tenants and it is important to understand which agreement applies to any given holding.
Do you act for landlords or tenants?
We act for both, depending on the instruction. Where there is any potential conflict of interest, we will identify this clearly at the outset and advise on how to proceed appropriately.
Can you help with an agricultural rent review?
Rent reviews are a core part of our work. We act for both landlords and tenants in reviews under both AHA and FBT legislation, using current market evidence and relevant case law to support negotiations and, where necessary, formal dispute resolution.
We have an informal grazing arrangement in place, do we need a formal tenancy?
Informal arrangements can create unintended legal consequences, particularly if they continue for an extended period or are not clearly documented. We can review the current position and advise on whether a formal licence or tenancy should be put in place to protect your interests.
